Privacy Policy
This Privacy Policy describes how Visuals & Visions LLC ("we," "us," or "our"), operating SoldNearYou, collects, uses, and handles information across three distinct surfaces:
- The SoldNearYou marketing website at go.soldnearyou.com — where businesses learn about and sign up for the platform
- Store catalog pages hosted at soldnearyou.com/[area]/[store-slug] — public browsing pages operated on behalf of our store clients
- The admin dashboard at soldnearyou.com/admin — where store owners and staff manage their catalog
These surfaces operate differently. Please read the relevant section for how you're interacting with us.
1. The SoldNearYou Marketing Website (go.soldnearyou.com)
What we collect
When you visit the SoldNearYou marketing website, we collect:
- Usage data — pages visited, time on page, referring URL, browser type, device type, and general geographic region (country/state level). This is collected automatically via analytics tools described below.
- Demo request form submissions — if you submit a demo request, we collect your name, business name, email address, phone number (optional), city and state, and your stated contact preference (email, phone call, or either). This information is used solely to schedule and conduct your demo and to follow up about SoldNearYou. We do not sell this information or share it with third parties except as necessary to operate our email and scheduling tools. You may request deletion of your submitted information at any time by emailing legal@visualsnvisions.com with subject line "Demo Request Deletion – [Your Name]."
Analytics tools
The marketing website uses:
- Google Analytics 4 (GA4) — tracks page views, session data, and user behavior in aggregate. Data is processed by Google LLC. See Google's Privacy Policy.
- Microsoft Clarity — records anonymized session replays and heatmaps to help us understand how visitors use the site. Data is processed by Microsoft Corporation. See Microsoft's Privacy Policy.
- Meta Pixel — tracks visitor actions on the marketing website to measure ad performance and build audiences for SoldNearYou advertising campaigns. Data is processed by Meta Platforms, Inc. See Meta's Privacy Policy.
All three tools use cookies and are active when you visit the marketing website. We display a notice informing you that cookies are in use. You can disable or manage cookies through your browser settings at any time.
How we use it
We use marketing site analytics to understand what content is useful, improve the website, and make product decisions. Demo request form submissions are used solely to schedule your demo and follow up about SoldNearYou.
2. Store Catalog Pages (soldnearyou.com/[area]/[store-slug])
Store catalog pages are public product browsing pages operated on behalf of independent businesses ("store clients") that use our platform.
What we collect on catalog pages
Inquiry form submissions: When a customer submits an inquiry about a product, we collect:
- Name (required)
- Email address and/or phone number (at least one required)
- Message content
- IP address (collected automatically from the request, used for abuse prevention — see below)
- Consent timestamp (when you check the consent box on the form)
Bot and typo verification: To keep inquiry submissions genuine, we use Cloudflare Turnstile to distinguish real submissions from automated ones. Turnstile may process your IP address and browser signals as part of this check. We also run a basic check that your email address's domain is configured to receive mail, which involves sending only the domain portion of your email (e.g. "gmail.com," never your full address) to Cloudflare's DNS resolution service. Both checks are processed by Cloudflare, Inc. — see Cloudflare's Privacy Policy.
We collect aggregate product interaction events on catalog pages (product views, click-to-call actions, and share actions) to provide store clients with a basic analytics dashboard. Each event records the event type, product ID, store ID, and an anonymous session token generated in your browser. The session token is not persistent — it is stored only in your browser's session memory and is cleared when you close the tab. No IP address, user agent, or location data is collected as part of these events, and no individual visitor is identified or tracked across stores.
Third-party tracking (store clients)
Individual store clients may have a Google Tag Manager (GTM) container active on their catalog page. A GTM container is managed entirely by the store client and may include tags such as a Meta (Facebook) Pixel, Google Ads conversion tracking, or other analytics tools. Each store's GTM container points to that store's own advertising accounts — not a SoldNearYou platform account.
The presence and contents of a GTM container on a given store's page are controlled by that store. Any tracking activity through GTM is governed by the store's own privacy practices and the policies of the relevant third-party tools (e.g., Meta's Privacy Policy, Google's Privacy Policy). If you have questions about a specific store's tracking, contact that store directly.
We do not receive data from store clients' GTM containers or the tags within them.
How we use inquiry data
Inquiry submissions are transmitted to the relevant store's admin dashboard so the store owner can respond. We do not sell, rent, or share inquiry data with third parties beyond what is necessary to operate the platform.
Retention: Inquiry records are retained for 90 days from submission, after which they are permanently deleted.
IP address: IP addresses collected on inquiry submissions are used solely for abuse detection and rate limiting. They are not shared with store clients or third parties.
3. Admin Users (Store Owners and Staff)
Authentication
Admin accounts are managed through Clerk (Clerk.com). Clerk handles login, session management, and organization membership. Your email address, password (hashed by Clerk — we never see it), and session data are stored with Clerk. See Clerk's Privacy Policy.
Images and files
Product images uploaded through the admin dashboard are stored on Cloudflare R2, Cloudflare's object storage service. Images are publicly accessible via URL once published to a catalog. See Cloudflare's Privacy Policy.
Share-Ready Posts, an optional graphic-export tool available to eligible plans, may also use Cloudflare Images (to remove the background from a product photo, only when an admin explicitly requests it) and Cloudflare Browser Rendering (to generate the final exported graphic). Both process store-owned product photos only — never customer or catalog-visitor data. See Cloudflare's Privacy Policy.
AI-assisted listing tools
Store clients on the Pro or Max plan may use optional AI-assisted tools — for listing creation, discount/offer copy, and Share-Ready Posts graphics — that are powered by Google Gemini (Google LLC). Depending on the specific tool, a product's title, category, uploaded photo, and/or store-entered promotional details may be sent to Google's Gemini API to generate a suggestion. These tools are a content-drafting aid for store admins only; we do not use them to make decisions about customers or catalog visitors, and any suggestion must be reviewed by the store before publishing.
4. Error Monitoring (All Surfaces)
We use Sentry (sentry.io) for application error monitoring across all surfaces. When an error occurs, Sentry may capture technical information including stack traces, page URL, browser/device type, and IP address. We take reasonable steps to minimize the inclusion of personally identifiable information (such as customer name, email, or phone number) in error payloads. See Sentry's Privacy Policy.
5. Data Storage and Security
Core platform data (product listings, store accounts, inquiry records) is stored on Neon (neon.tech), a managed PostgreSQL database service hosted in the United States. Data is encrypted in transit (TLS) and at rest. See Neon's Privacy Policy.
Aggregate catalog interaction events (product views, clicks, shares) are stored in Cloudflare Analytics Engine, Cloudflare's time-series analytics infrastructure. These events contain no personal information. See Cloudflare's Privacy Policy.
We implement reasonable technical and organizational measures to protect your data. No method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

You can control cookies through your browser settings. Disabling cookies on the admin dashboard will prevent you from logging in.
7. Children's Privacy
SoldNearYou is not directed at children under 13. We do not knowingly collect personal information from children under 13. If you believe we have inadvertently collected such information, please email legal@visualsnvisions.com with the subject line "Children's Privacy – Deletion Request" and we will delete it promptly.
8. U.S. State Privacy Rights (California)
Pursuant to the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), California residents have the following rights with respect to their personal information:
- Right to Know — the specific pieces and categories of personal information we have collected about you, the sources, the purposes, and any third parties with whom it has been shared.
- Right to Delete — request deletion of personal information we have collected, subject to applicable legal exceptions.
- Right to Correct — request correction of inaccurate personal information we hold about you.
- Right to Non-Discrimination — we will not discriminate against you for exercising any of these rights.
Do we sell or share personal information? We do not sell personal information to third parties for monetary or other valuable consideration. We do use the Meta Pixel on our marketing website (go.soldnearyou.com) to measure ad performance and build audiences for our own advertising campaigns, which may be considered "sharing" for cross-context behavioral advertising under the CPRA. We do not use the Meta Pixel, or share data in this way, on store catalog pages or the admin dashboard. If you would like to opt out of this sharing, email legal@visualsnvisions.com with the subject line "CA Do Not Share Request" and we will honor your request; you can also block the Meta Pixel directly through your browser's cookie or tracking-protection settings.
Submit a request: Email legal@visualsnvisions.com with the subject line "CA Privacy Request – [Your Name]", a description of your request, and enough information to verify your identity. We will respond within 45 days, with an extension of up to 45 additional days where reasonably necessary.
Complaints: California residents may file a complaint with the California Privacy Protection Agency.
9. U.S. State Privacy Rights (General)
Residents of Colorado, Connecticut, Delaware, Iowa, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Tennessee, Texas, Utah, and Virginia may have the following rights under applicable state privacy laws:
- Access — confirm whether we are processing your personal information and obtain a copy of it.
- Correct — request correction of inaccurate personal information.
- Delete — request deletion of personal information we hold about you.
- Portability — obtain a copy of your personal information in a portable, readily usable format.
Do we sell personal information? No. We do not sell personal information to third parties for monetary consideration. As noted above, we do use the Meta Pixel on our marketing website for advertising purposes, which some state laws may treat similarly to a "sale" for targeted-advertising purposes. Email legal@visualsnvisions.com with the subject line "Do Not Share Request" if you'd like to opt out.
Submit a request: Email legal@visualsnvisions.com with the subject line "Privacy Request – [Your Name]". We will respond within 45 days, with an extension where permitted by law. You may designate an authorized agent to submit a request on your behalf where permitted.
Appeals: If we decline your request, you may appeal by emailing legal@visualsnvisions.com with the subject line "Privacy Request Appeal" and a description of your request and the reason for appeal. We will respond within the timeframe required by applicable law.
Complaints: You may file a complaint with your state's relevant data protection authority.
10. Business Transfers
If Visuals & Visions LLC is involved in a merger, acquisition, or sale of all or a portion of its assets, personal information we hold may be transferred to the acquiring entity as part of that transaction. We will provide notice of any such transfer and any choices you may have by updating this Privacy Policy.
11. Changes to This Policy
We may update this Privacy Policy from time to time. When we do, we will update the "Last updated" date at the top. Material changes will be communicated to store clients directly. Continued use of the platform after changes take effect constitutes acceptance of the updated policy.
